이용약관

제1조 적용 / Scope

이 약관은 buildandshow.com과 빌드앤쇼의 홈페이지·영상 제작 대행 서비스에 적용됩니다. 크몽을 통한 주문에는 크몽의 약관과 정책이 먼저 적용되고, 이 약관은 그 밖의 사항을 보충합니다.

These Terms apply to buildandshow.com and Build & Show's website and video production services. For orders placed through Kmong, Kmong's terms and policies apply first, and these Terms cover anything they do not address.

제2조 견적과 계약 / Quotes and Contracts

회사는 작업 범위·수정 횟수·일정·금액을 적은 견적서를 보냅니다. 고객이 이메일로 동의하고 선금을 입금하면(크몽은 결제 완료 시) 계약이 성립합니다. 표시 가격은 부가세를 포함합니다. 대금은 견적서에 정한 방법으로 냅니다. 견적서에 정함이 없으면 30만 원 미만은 착수 전 전액, 30만 원 이상은 착수 전 50%·납품 승인 시 50%입니다.

We send a quote stating scope, number of revisions, schedule, and price. A contract is formed when you accept by email and pay the deposit (for Kmong, upon payment). Prices include VAT. Payment follows the quote. If the quote is silent, jobs under KRW 300,000 are paid in full before work starts; larger jobs are paid 50% before work starts and 50% upon acceptance of delivery.

제3조 고객 자료 / Client Materials

고객은 제공하는 자료가 제3자의 권리를 침해하지 않음을 보장합니다. 회사는 법령 위반 소지가 있는 내용의 반영을 거부할 수 있습니다. 예를 들어 의료기관 홈페이지의 환자 후기, 전후 사진, 효과 보장이나 최상급 표현이 여기에 해당합니다.

You warrant that materials you provide do not infringe anyone's rights. We may refuse to include content that may violate the law — for example, patient testimonials, before-and-after photos, or guaranteed-results and superlative claims on medical websites.

제4조 수정 / Revisions

수정 횟수와 범위는 견적서 또는 크몽 상품 페이지에 정한 대로 따릅니다. 구조 변경이나 새 섹션·새 페이지 추가는 수정이 아니라 추가 작업으로 보고 별도로 견적합니다.

The number and scope of revisions follow the quote or the Kmong listing. Structural changes or new sections or pages are additional work, not revisions, and are quoted separately.

제5조 납품과 검수 / Delivery and Acceptance

배포된 주소 또는 파일로 납품합니다. 고객은 납품일부터 7일 안에 검수 결과를 알려야 합니다. 이 기간 안에 알리지 않으면 승인한 것으로 봅니다.

We deliver via a live URL or files. Please review within 7 days of delivery; if we receive no response within that period, the delivery is deemed accepted.

제6조 취소와 환불 / Cancellation and Refunds

착수 전 취소: 전액 환불
착수 후 첫 결과물 전달 전: 50% 환불
첫 결과물 전달 후: 환불 없음
회사 사정으로 납기를 넘기거나 계약을 이행하지 못한 경우: 전액 환불
크몽 주문은 크몽 환불 규정을 따릅니다.

Cancellation before work starts: full refund. After work starts but before the first draft is delivered: 50% refund. After the first draft is delivered: no refund. If we miss the deadline or fail to perform for reasons on our side: full refund. Kmong orders follow Kmong's refund rules.

제7조 저작권 / Intellectual Property

① 대금을 모두 치르면 결과물(디자인·코드·영상)의 저작재산권은 2차적저작물작성권을 포함해 고객에게 양도됩니다.

② 다만 다음은 예외입니다.

폰트·스톡 이미지·오픈소스 등 제3자 라이선스 자산은 해당 라이선스 조건대로 이용권을 드립니다.
회사가 이전부터 보유한 범용 코드·템플릿은 비독점·영구 이용권을 드립니다.
AI로 생성한 요소는 법령상 저작권이 인정되지 않을 수 있습니다. 회사는 이에 대해 권리를 주장하지 않으며, 사용한 도구의 상업 이용 조건 범위에서 이용할 수 있게 합니다.

③ 대금을 모두 치르기 전에는 결과물을 사용할 수 없습니다.

④ 회사는 결과물을 포트폴리오에 게시할 수 있습니다. 고객이 거부하면 게시하지 않습니다.

① Upon full payment, the economic rights in the deliverables (design, code, video), including the right to create derivative works, transfer to you.

② Exceptions: third-party licensed assets (fonts, stock images, open-source code) are licensed to you on their own terms; general-purpose code and templates we owned beforehand are licensed to you on a non-exclusive, perpetual basis; AI-generated elements may not be protected by copyright under the law — we claim no rights in them and ensure you can use them within the commercial-use terms of the tools we used.

③ Deliverables may not be used before full payment.

④ We may show deliverables in our portfolio unless you object.

제8조 사후 지원 / After-Delivery Support

납품 후 30일 동안 회사 책임인 오류는 무상으로 고칩니다. 도메인·호스팅 계정은 고객 명의로 두는 것을 권장합니다.

For 30 days after delivery, we fix defects caused by us free of charge. We recommend that domain and hosting accounts be held in your name.

제9조 책임 제한 / Limitation of Liability

회사의 배상 책임은 해당 계약 대금을 한도로 하며, 간접 손해에는 책임을 지지 않습니다. 다만 회사의 고의 또는 중대한 과실로 인한 손해에는 이 제한을 적용하지 않습니다.

Our liability is limited to the contract price, and we are not liable for indirect damages. This limit does not apply to damage caused by our intent or gross negligence.

제10조 YouTube API 서비스 / YouTube API Services

회사의 게시 도구는 YouTube API 서비스를 사용합니다. 이 도구를 사용하는 사람은 YouTube 서비스 약관(https://www.youtube.com/t/terms)에 구속되는 데 동의합니다. 개인정보 처리는 https://buildandshow.com/privacy를 따릅니다.

Our Publishing Tool uses YouTube API Services. By using the tool, users agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms). Privacy is governed by https://buildandshow.com/privacy.

제11조 준거법과 관할 / Governing Law

대한민국 법을 따르며, 분쟁은 민사소송법에 따른 관할 법원에서 해결합니다.

These Terms are governed by the laws of the Republic of Korea, and disputes will be resolved in the competent court under the Korean Civil Procedure Act.

제12조 변경 / Changes

약관을 바꾸면 시행 7일 전에 이 페이지에 알립니다.

We will post changes on this page at least 7 days before they take effect.
